TERMS OF SERVICE

Agreement

If the client utilizes any of the services of OmniScenic, Inc., they are bound to the terms of service as outlined herein. It is the responsibility of the client to assume that a terms of service exists, and that it should be read and understood prior to utilizing OmniScenic services.

Copyright

OmniScenic retains all rights to delivered content including but not limited to images, videos, graphics, 3d virtual tours & 360° video productions. All delivered material produced for the client is licensed, not sold, and may be used by the client for all marketing purposes in accordance with the current united-states copyright law.

Delivered content including images, videos, graphics, 3d virtual tours & 360° video productions will be licensed for a length of time determined at the time the original estimate is given. A client who orders 3D Virtual Tours, in addition to OmniScenic’s terms of service, is subject to Matterport’s terms of service.

Additional Usage

Subsequent usage of any deliverable OmniScenic content, such as transferring the deliverable to another agent, trade, or service, requires a separate licensing agreement and an additional fee to be agreed upon.

OmniScenic may use all delivered content for its own promotional purpose at any time, unless otherwise agreed upon.

Estimates

Any fees quoted by OmniScenic are for the original job description as presented by the client. Any subsequent changes, whether made orally or in writing, may result in additional charges. Estimates are made in good faith of the time and expenses the company anticipates and any errors and omissions made may be charged at our discretion.

Payment

Unless otherwise agreed upon, the client shall make full payment after the production, and upon receipt of the invoice. Grant of deliverable is conditioned upon receipt of payment in full. Payment may be made by e-transfer, credit card, cash or check. For projects that are over $1000, a 25% deposit is due before work commences.

Scheduling

Please contact us via telephone at (833) 272-3642 or our contact form to schedule your appointment 24 to 48 hours in advance. Last minute appointments will be accommodated upon availability.

Cancellation / Rescheduling

If cancellation or rescheduling is necessary for any appointment, we prefer at least 48 hours of notice.

If cancellation or rescheduling is necessary for any appointment, a minimum 24-hour notice must be provided, otherwise a $100 minimum charge will apply.

On site cancellations will incur the full cost of the appointment.

Area Preparation

It is essential that the area is prepared and ready upon the arrival of OmniScenic.

Area Preparation Checklist for Larger Projects

An area preparation checklist will be provided for larger projects. If the area is not ready (as per checklist), OmniScenic may choose to wait until the area is ready, or come back at a different time/day. Waiting, if applicable, is charged at $100 per hour or portion thereof and added to the invoice. If OmniScenic must come back to complete a scheduled job, a minimum charge of $100 will apply.

On-site Services

On-site services can take anywhere between an hour to a full working day to complete (or more), depending on property size and services chosen.

Please contain all pets in an area(s) that will not be captured.

Delays incurred on-site falling outside the scope of work required by any member of the OmniScenic team will be billed to the client at $100 per hour.

Delivery / Archival

3D virtual tours are typically available within 24 to 48 hours after the shoot. 360° video projects are typically available within 5 business days or more depending on the size of the project. All content is edited and optimized for quality before delivery. Content and/or content access may be delivered via email and/or cloud storage services (dropbox, google drive, etc).

3D virtual tours are hosted with OmniScenic. Residential & commercial real estate tours are hosted and live for up to a year unless sold before then or unless otherwise agreed upon. Business & luxury amenity tours are hosted and live for as long as agreed upon.

Google street view/business view virtual tours are hosted on the client’s google my business page. The Client has the option to upload and arrange the 360 panoramic photos themselves (upon online delivery from OmniScenic), or hire OmniScenic to upload and transfer the virtual tour to the client at an additional fee to be agreed upon during pre-production.

360 video production times vary depending on the complexity of the projects. Finalized 360 videos are uploaded to the OmniScenic YouTube and/or Vimeo 360 channels, and licensed to the client for a length of time determined at the time the original estimate is given. Video files are also available upon request via cloud storage services (dropbox, google drive, etc) at an additional fee to be agreed upon during pre-production.

The client will receive an email once the media has been processed along with the content via any of the following depending on the type of content: web URL, embed URL, attached zip file or cloud storage file. If necessary, other forms of online storage can be arranged prior to the appointment date. Additional assistance to obtain the delivered files and/or to assist with the uploading and/or embedding of the content to a website/other can be purchased for an extra fee.

*Delivery times are approximations based on averages. Larger projects with custom requirements take longer to process.

Additional Fees

Travel – A travel fee applies for areas outside of South Florida. If a travel fee applies to you, it will be discussed prior to the appointment date, and included in your estimate.

Travel to North Florida: $150 | Travel to any other state varies depending on location

If a shoot outside of South Florida requires overnight lodging, the lodging will be paid for and provided by the client.

Parking – A parking fee may be applied to your invoice if the OmniScenic producer incurs this expense to complete the service.

Client Representation

The client is responsible to be present at the beginning of the shoot to approve OmniScenic member’s interpretation of the assignment. If the client is not present, the producer’s interpretation shall be deemed acceptable.

Indemnification

The client hereby indemnifies and holds the company harmless against any and all liabilities, claims, and expenses, including lawyer’s fees, arising from the client’s use of the company’s work/content.
